Caned 18-year-old schoolboy runs to court
An 18-year-old schoolboy tried to take his teacher to court after he gave him three strokes of the cane across the backside.
CANED PUPIL’S
SUMMONS
APPLICATION
REJECTED
An 18-year-old pupil at The
Oratory School, Henley, applied for a summons of assault against one of his
teachers at Henley Magistrates’ Court. He alleged that the teacher gave him
three strokes with a cane.
The application – which was
refused – was heard by the magistrates in a private room. Press and public were
not present.
The schoolboy, Gerald
Tyrrel, applied for the summons under section 42 of the Offences Against the
Person Act 1861.
He alleged that the teacher
hit him on the buttocks three times. But the magistrates decided there was
nothing abnormal, brutal or unusual in the caning, and refused the application.
They told the boy that as
he was under 21 he should consult with his parents and seek legal advice.
